Terms of Service

These terms describe how the product behaves and what each side is responsible for. They are written to be read. They are not legal advice, and for a negotiated enterprise agreement or a signed DPA, talk to us.
1. The agreement
By creating a Kiln workspace you agree to these terms on behalf of yourself and, if you are signing up for an organisation, on behalf of that organisation. You must be able to enter a contract where you live.
We may change these terms. If a change materially reduces your rights we will tell you by email before it takes effect, and continuing to use Kiln after that date is your acceptance. Price changes never apply to a billing period you have already paid for.
2. What the service is
Kiln is a data-orchestration tool. You bring a list, choose data providers, and Kiln calls those providers in the order you configure, stores the results in your workspace and records what each call cost.
Kiln does not own, license or resell a contact database of its own. Where you supply your own provider API keys, your relationship for that data is with the provider and their terms apply to it as well as ours. Where you use credits, we buy the call on your behalf under our own agreement with that provider.
Providers without a configured key return clearly-labelled sample data. Sample data is fictional, is marked as such in the API response and provenance log, and is never billed.
3. Credits and billing
You are charged for a provider call only when it returns a verified result. A miss is free. A provider error is free. An unverifiable email guess is free. A repeat of a lookup already in your cache is free. Sample data is free.
Kiln meters two things: data credits, spent by enrichment provider calls, and actions, spent by AI agent runs. Both are recorded in an append-only ledger you can read at any time, showing the row, the column, the provider and the reason for every entry.
Before any run, Kiln shows an estimate computed from each provider's declared hit rate and your waterfall order. The estimate is a forecast, not a quote: real match rates vary by list. The ledger, not the estimate, is the record of what you owe.
Every workspace has a hard spend cap, on by default at your plan allowance. Runs that would exceed it are refused server-side before any provider is called. Overage, where your plan has a published rate, is billed at that rate — currently $0.016/credit on Starter, $0.012/credit on Growth, $0.0099/credit on Scale.
Paid plans renew monthly until cancelled. Cancelling stops the next renewal and you keep access until the end of the period you have paid for. Unused monthly credits do not roll over. Purchased top-up packs do not expire while your workspace is active.
We do not refund credits already spent on results that were delivered. If you believe you were billed for an unverified or duplicate result, open a provider dispute in the app: the provenance log records enough to settle it, and where we are wrong we credit it back.
4. Your data stays yours
You own the lists you import and the results in your workspace. We do not sell them, and we do not use one customer's workspace data to enrich another's. You can export any table to CSV at any time.
We may use aggregate, de-identified operational metrics — provider hit rates, latency, error rates — to improve waterfall ranking and the provider scorecard. That data contains no contact records and no customer identifiers.

5. Acceptable use
You agree not to use Kiln to:
- process data you have no lawful basis to process, or that you obtained in breach of someone else's terms;
- contact people who have opted out — add them to your suppression list instead, which stops the provider call as well as the export;
- enrich consumer data, or any special-category data (health, biometrics, political opinions and the like). Kiln is a B2B tool;
- send unsolicited bulk mail in breach of CAN-SPAM, PECR, CASL or your local equivalent;
- circumvent rate limits, spend caps or metering, including by sharing one workspace across unrelated organisations;
- resell raw provider output as a data product, as opposed to using it in your own go-to-market.
We can suspend a workspace that is doing any of the above. Where the breach is not deliberate we will ask you to fix it first.
6. Availability and support
We aim for high availability but do not offer a contractual uptime guarantee on self-serve plans. Enrichment depends on third-party provider APIs; when one of them is down, Kiln records the failure as a typed error, does not bill you for it, and continues down your waterfall.
Support is by email on paid plans, prioritised on Growth and Scale. Free workspaces get best-effort support.
7. Termination
You can delete your workspace at any time from the app. On deletion we remove your tables, provenance, cached provider payloads and stored provider keys within 30 days, keeping only the billing records we are legally required to keep.
We can terminate for non-payment or for a serious breach of section 5. Except in cases of abuse we will give you 14 days' notice and an opportunity to export your data.
8. Warranties and liability
Kiln is provided as-is. We do not warrant that provider data is accurate, current or complete — we pass through what the provider returns, along with a confidence score and the provider's identity, so you can judge it. Deliverability, bounce rates and campaign outcomes are not something we can warrant.
To the extent the law allows, our total liability in any 12-month period is limited to the amount you paid us in that period, and neither side is liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
